HUMAN REVIEW – TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your access to and use of the services offered by Human Review (“Human Review”, “we”, “us”, “our”). By accessing our website, submitting documents, or purchasing a review, you (“you”, “User”, “Client”) agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
Overview
A Human Review provides a digital platform and associated services allowing Users to upload documents for human-performed review and feedback (“Review”). Feedback is provided by independent experts (“Reviewers”), and is intended solely as general commentary and informational insight. The Service is not professional, regulated, certified, or licensed advice. No professional-client or fiduciary relationship is created.
Nature of the Service
2.1 The Review may include written comments, annotations, suggestions, observations, or critiques of your submitted content (“Submitted Materials”). All feedback is subjective opinion based on the Reviewer’s personal experience and interpretation.
2.2 The Service is not:
- legal advice
- financial, investment, tax, accounting or business advisory
- medical or clinical advice
- architectural, engineering, structural, or building compliance advice
- safety-critical assessment
- any service requiring accreditation, certification, or licensing
2.3 The Review should not be relied upon as factual, comprehensive, or guaranteed to be correct. You agree to independently verify all important information.
2.4 You remain solely responsible for any decisions, actions, or outcomes arising from your use of the Review.
Reviewers
3.1 Reviewers engaged by Human Review are independent contractors, not employees, partners, or agents.
3.2 We may perform reasonable credential checks; however, we make no guarantees as to Reviewer expertise, qualification, accuracy, or suitability.
3.3 A Human Review is not responsible for Reviewer opinions, errors, or omissions.
User Responsibilities
4.1 Ownership & RightsYou retain ownership of all Submitted Materials. You grant Human Review a non-exclusive, worldwide, royalty-free licence to host, process, and display Submitted Materials solely to provide and improve the Service.
4.2 Prohibited ContentYou must not submit materials that:
- contain personal medical, legal, financial, or safety-critical information
- infringe intellectual property rights
- breach confidentiality owed to others
- include defamatory, abusive, discriminatory, or unlawful content
- contain malware, viruses, dangerous macros, or harmful code
- attempt to exploit or interfere with the platform
4.3 AccuracyYou are responsible for the accuracy and completeness of Submitted Materials. Errors or omissions in your inputs may affect the quality or relevance of the Review.
Confidentiality & Data Handling
5.1 We treat all Submitted Materials as confidential. They will not be shared, published, or distributed except:
- to the assigned Reviewer, or
- when required by law, court order, or regulatory authority.
5.2 Submitted Materials may be stored temporarily for operational or administrative purposes. We endeavour to delete them within 30 days after the Review is delivered unless retention is legally required.
5.3 We do not use Submitted Materials to train AI models or for marketing purposes.
Delivery & Turnaround Times
6.1 All turnaround times displayed on the website or at checkout are estimates only and are not guaranteed.
6.2 Delays may occur due to complexity, workload, technical issues, or other unforeseen circumstances.
6.3 A Human Review is not liable for delays or any resulting loss, cost, or inconvenience.
Payment, Refunds & Service Refusal
7.1 Payment must be made in full before work begins. Payments are processed by third-party providers (e.g., Stripe) under their own terms.
7.2 Due to the labour involved, completed or in-progress Reviews are non-refundable, except where required by law or at our discretion.
7.3 We reserve the right to refuse, cancel, or delete submissions that:
- fall into restricted categories (Section 8)
- violate these Terms
- pose risks to Reviewers or systems
- cannot reasonably be reviewed
If work has not commenced, a refund may be issued at our discretion.
Restricted or Prohibited Topics
8.1 We may not accept or process content relating to:
- medical diagnosis, treatment, or health-critical guidance
- legal disputes, legal drafting, or compliance interpretation
- financial, investment, or taxation strategy
- structural engineering, building safety, or regulatory compliance
- high-risk safety matters or emergency instructions
We may decline or delete submissions at our sole discretion.
Intellectual Property
9.1 You retain ownership of Submitted Materials.
9.2 We retain all intellectual property rights in the Review, including:
- written comments and annotations
- templates, methodologies, and analytical frameworks
- proprietary formatting and structure
9.3 Upon payment, we grant you a non-exclusive, non-transferable licence to use the Review for your personal or internal business purposes.
9.4 You may not:
- resell or redistribute the Review
- publish it publicly
- use it to provide competing services
- misrepresent the Review as certified or professional advice
Limitation of Liability
10.1 To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind.
10.2 Human Review, its directors, employees, contractors, and Reviewers are not liable for any:
- loss or damage arising from reliance on a Review
- business or financial decisions made using our feedback
- indirect, consequential, incidental, or special damages
- errors, omissions, or subjective opinions in any Review
10.3 You acknowledge that human review is inherently subjective and may contain mistakes.
10.4 Our total liability for any claim relating to the Service is limited to the amount you paid for that specific Review.
Governing Law
These Terms are governed by the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
Modifications
We may update these Terms at any time. Continued use of the Service after changes indicates acceptance.
